These Terms of Service (“Terms”) govern your access to and use of Artwork Gallery (the “Website”) and any related submissions, publications, or services.
By submitting materials, applying for publication, or making a payment through the Website, you agree to be bound by these Terms.
Artwork Gallery is an independent online publication operated by Anna Ponomarenko.
2. Submissions & Applications
Artwork Gallery accepts artist submissions through online forms (including Gravity Forms) as part of open calls for curated interviews and publications.
By submitting an application, you confirm that:
- All information provided is accurate and truthful
- You are the creator or legal rights holder of the submitted works
- You have the right to submit the materials for editorial review and potential publication
Submission does not guarantee selection or publication.
3. Curatorial Review & Selection
All submissions are subject to editorial and curatorial review.
Artwork Gallery reserves the right to:
- Accept or reject any submission at its sole discretion
- Limit the number of selected artists
- Determine the format, placement, and presentation of published content
Decisions are based on editorial focus, curatorial criteria, and available publication space, and are not a judgment of artistic quality.
4. Fees & Payments
A publication fee applies only to selected artists.
- No payment is required at the submission stage
- Payment is requested only after curatorial approval
- Payments are processed securely via Stripe
Artwork Gallery does not store or process payment card details directly.
5. No Refund Policy
Due to the editorial and digital nature of the services provided:
All payments are final and non-refundable.
Once payment is completed, editorial work, interview preparation, design, and publication processes begin immediately. For this reason, refunds cannot be issued.
6. Publication & Content Use
If selected and published, your content may appear on:
- The Artwork Gallery website
- Digital publications or PDF features
- Artwork Gallery social media channels
Artwork Gallery reserves the right to edit submitted texts for clarity, length, and formatting while preserving the original meaning.
7. Intellectual Property Rights
a) Your rights
You retain full ownership of your artworks, texts, and intellectual property.
b) License granted to Artwork Gallery
By submitting materials, you grant Artwork Gallery a non-exclusive, royalty-free, worldwide license to:
- Publish and display your content
- Promote the publication and related editorial content
- Archive the publication as part of the Website and digital editions
This license does not restrict you from using your work elsewhere.
8. Removal Requests
Published content is intended to remain part of the editorial archive.
Removal requests may be considered on a case-by-case basis but are not guaranteed, especially after publication has been completed.
9. Communications & Marketing
By submitting your email address, you may receive:
- Communication related to your submission or publication
- Optional newsletters or announcements about future open calls
You may unsubscribe from marketing communications at any time.
10. Third-Party Services
Artwork Gallery relies on third-party services for its operation, including:
- Payment processing (Stripe)
- Form handling (Gravity Forms, Google Forms)
- Analytics and affiliate tracking
Artwork Gallery is not responsible for the privacy practices or terms of these third parties.
11. Limitation of Liability
Artwork Gallery shall not be held liable for:
- Technical issues beyond its control
- Delays caused by third-party services
- Decisions made by external institutions (e.g. galleries, visa authorities) based on published content
Publications do not guarantee professional, commercial, or immigration outcomes.
12. Changes to the Terms
Artwork Gallery reserves the right to update these Terms at any time.
Changes will become effective immediately upon posting on this page. Continued use of the Website constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with applicable international laws, without regard to conflict of law principles.
